Court Adjourns Abu Trica Case as State Withdraws Charges Against Two Accused

Gbese District Court refuses to discharge two accused persons, fixes ruling for February 7

Court Adjourns Extradition Proceedings

The Gbese District Court in Accra has adjourned its ruling in the extradition proceedings involving Frederick Kumi, popularly known as Abu Trica, after the State disclosed that it has no evidence against two of the accused persons.

Despite the admission, the court declined to discharge the two individuals and adjourned the case to February 7, 2026, for a ruling.

State Admits No Evidence Against Two Accused

The two accused persons, Lord Eshun and Bernard Aidoo, were arraigned as alleged accessories under an extradition charge sheet filed on December 12, 2025.

However, the prosecution informed the court that investigations had been concluded and there was no basis to continue proceedings against them.

Representing the Attorney-Generalโ€™s Department, Derick Ackah Nyameke told the court that although the two were charged under Section 6 of the Extradition Act, 1960 (Act 22), the Republic needed time to โ€œput its house in orderโ€.

Defence Challenges Case Against Abu Trica

Counsel for Abu Trica, Oliver Barker Vormawor, argued that once the alleged conspirators were withdrawn from the case, the charges against his client could no longer stand.

โ€œOne person cannot be found guilty of an alleged conspiracy because the alleged conspirators are no longer before the court,โ€ he said.

He added that the charge sheet did not mention any unidentified conspirators, insisting that the entire case against Abu Trica had collapsed.

Prosecution Opposes Discharge

The prosecution opposed the request to discharge Abu Trica, arguing that he was not standing trial in Ghana, but was before the court as part of extradition-related committal proceedings.

Mr Nyameke explained that under Act 22 and the 1931 extradition treaty, a fugitive could be provisionally arrested and presented before a district court while extradition processes are completed.

He described the defenceโ€™s objection as premature and noted that a motion to stay the extradition proceedings had also been filed.

Court Fixes February 7 for Ruling

Presiding judge Justice Bernice Ackon declined to discharge any of the accused persons and adjourned the case to February 7, 2026, for ruling.

Defence Reacts, Files Bail Application

Speaking to the media after the hearing, defence counsel Aggrey-Finn Amissah criticised the courtโ€™s refusal to discharge the two accused persons despite the Stateโ€™s position.

โ€œThe prosecution is at the discretion of the state, yet the judge decided not to discharge persons the state itself says there is no evidence against,โ€ he said.

He disclosed that the defence has since filed a bail application at the High Court, which is expected to be heard on January 20, 2026.
